The legal bill needed more than one category

Identify support-related legal costs, separate divorce and custody work, and keep an itemized allocation for the federal deduction.

Ariane makes notes during a call about an itemized bill at a library work table.

The invoice said “family matter.” That described several difficult months very efficiently, but it did not tell me what belonged on my tax return.

Some of the work established child support. Some dealt with parenting arrangements. I had paid one law firm, but the purpose of each charge mattered more than the firm's name at the top.

Start with the recipient's eligible work

A support recipient can generally deduct eligible legal and accounting fees incurred to collect overdue support, establish support from a current or former spouse or common-law partner, or seek an increase. Establishing support from another legal parent of the child has a court-order condition. These ordinary eligible costs go to line 22100. Costs to try to make child support non-taxable have a separate line 23200 rule. CRA's recipient instructions.

The CRA's technical guidance also covers defending against a reduction. The deduction can apply even though the child support itself is not taxable. An unsuccessful claim is not automatically excluded, provided it was bona fide, not frivolous and had a reasonable chance of success. Support-payment folio, paragraphs 3.81 to 3.83.

Separate the rest of the family-law bill

Fees to obtain a divorce or separation, establish custody or access, or divide family assets are not deductible under this support rule. Nor are fees to collect a lump sum that does not qualify as support. A payer cannot deduct costs to establish, negotiate, contest, reduce or end their support obligation. Being involved in the same proceeding does not give both parties the same deduction.

I asked for an allocation based on the work performed. A guessed percentage would have been easier to write down and harder to explain later.

Suppose the itemized bill supports $1,600 of eligible work establishing child support, $900 for custody arrangements and $500 for dividing property. With no reimbursement or costs award, the support-related deduction in this example is $1,600, not the full $3,000. That is a deduction from income, not a $1,600 refund.

Account for a costs award

If a costs award covers eligible legal and accounting fees, only the net cost is deductible. Where the fees were deducted in an earlier year, the CRA says the award is included in income when received. Keep the award and its timing with the invoice; do not claim the same economic cost twice. Folio, paragraph 3.84.

My file ended up containing the detailed invoice, the allocation explanation, payment records and the relevant support documents. The tax question became manageable once “family matter” was divided into the work actually done.
